Information and Advisory Points run by the Partner will provide assistance and advisory support to persons referred to in Council Implementing Decision (EU) 2022/382 of March 4, 2022 stating the existence of a mass influx of displaced persons from Ukraine within the meaning of art. 5 of Directive 2001/55/EC and resulting in the introduction of temporary protection, i.e. persons who had to leave Ukraine starting from February 24, 2022 following the military invasion:
(a) citizens of Ukraine residing in Ukraine before 24 February 2022;
(b) stateless persons or nationals of third countries other than Ukraine who benefited from international protection or equivalent national protection in Ukraine before 24 February 2022;
(c) family members of the persons referred to in point (a). a) and b).
Leader:
The final beneficiaries of the project will be:
- Foreigners who are not EU citizens, residing legally in the territory of the Republic of Poland, in accordance with the provisions of the Act of 12 December 2013 on foreigners (Journal of Laws of 2017, item 2206, as amended):
- on the basis of a visa referred to in art. 60 sec. 1 point 4-6, 9-13, 17, 18a-21, 23-25,
- on the basis of a temporary residence permit, permanent residence (Article 195, with the exception of section 1 point 6a, however, this exclusion does not apply to persons who have received a residence permit for humanitarian reasons),
- or a long-term resident's EU residence permit (Article 211),
- on the basis of a document confirming the possession of a permit for tolerated stay called "permit for tolerated stay" (Article 226(5)),
- residence permit for humanitarian reasons,
- Children of the above persons (who are not EU citizens) born on the territory of the Republic of Poland and children of Ukrainian citizens residing on the territory of the Republic of Poland in accordance with art. 32 of the Act on foreigners from February 24, 2022. Other children are subject to the conditions of points 1, 3, 4, 5 and 7, respectively.
- They stay on the territory of the Republic of Poland as part of visa-free travel.
- Foreigners who are not EU citizens, residing on the territory of the Republic of Poland, who are in the process of obtaining a permit for legal residence in Poland.
- Spouses, ascendants and descendants of persons belonging to the above groups. 1-4 and 7 and 8, to the extent necessary for the effective implementation of activities, including citizens of Poland or other European Union countries.
- Persons who are not EU citizens, residing legally in the territory of the Republic of Poland, who have submitted an application for:
- granting a temporary residence permit to a foreigner (Article 108),
- granting a foreigner a permanent residence permit (Article 206),
- granting a foreigner a long-term resident's European Union residence permit (Article 223),
- extension of a Schengen visa or a national visa (Article 87), where the justification is in line with one of the following purposes indicated in Article 60 sec. 1: pt. 4-6, 9-13, 17, 18a-21, 23-25,
- extension of the period of stay under visa-free travel on the territory of the Republic of Poland (Article 300) and obtained a stamp in the travel document confirming the submission of the correct application.
- Foreigners who are not EU citizens, residing legally in the territory of the Republic of Poland, in accordance with the provisions of the Act of 14 July 2006 on entering, staying and leaving the territory of the Republic of Poland of citizens of European Union Member States and their family members (Journal Journal of Laws of 2006, No. 144, item 1043):
- on the basis of the right of residence for a period longer than 3 months (Article 18) or the right of permanent residence (Article 43).
- British citizens legally residing in Poland.
